2017 ended ‘with a bang’ for Vogelzang Law and Their Mesothelioma Clients

Attorney Nicholas Vogelzang and his associates Wyatt Berkover and Michael Maienza wrapped up two more mesothelioma cases in December of 2017 against over 40 corporate defendants. Joseph Licko worked as a residential and commercial plumber as a Chicago local 130 plumber. In his work, he was frequently exposed to asbestos insulation on piping, valves, and pumps. In addition, he was exposed to asbestos gaskets, floor tile, joint compound, boilers, and caulk. The case was filed in January of 2017 and completely settled by December of the same year.

Cook County allows for an expedited trial setting for plaintiffs with mesothelioma so that they can have their day in court, given the difficult prognosis of the disease. Vogelzang Law prides itself on getting some of the fastest trial dates in the country on behalf of mesothelioma patients and their families.

At the time of trial, the defendant Burnham Boilers remained and argued several pretrial motions against plaintiff’s attorney Nicholas Vogelzang and his associates Michael Maienza and Wyatt Berkover, in front of the Honorable Judge Harmening at the Daley Center. After two days of both pretrial settlement negotiations and pretrial motion practice, the parties were able to reach an amicable settlement and a jury trial was avoided.

In addition to Joseph Licko’s case, Vogelzang Law also represented the family of Peter Terpsma for trial from Pete’s work at Batt’s Plastics. This work exposed him to asbestos-containing plastics as well as asbestos-insulated pipes, valves and equipment. Pete was exposed in the late 1960’s and early 1970’s to asbestos-laden dust and consequently, the cancer manifested with a diagnosis of mesothelioma in the summer of 2016. Vogelzang Law was able to resolve the entire case against all defendants prior to any pretrial motions, providing the family with some closure after dealing with the very difficult diagnosis of mesothelioma that struck the patriarch of the family.

Vogelzang Law frequently is able to both file a case and resolve it within 12 months. This allows for families to move on with their lives and hopefully be able to use the compensation for medical bills and other expenses involved with such a serious cancer. Through these settlements, many families have also been able to assist their grandchildren with the high cost of college education.
