Chicago Tuesday Asbestos Call: Team Preps for Winter Trials

The Daley Center hosts an Asbestos Call every other Tuesday, which serves as the time and place to track the progress of a lawsuit in preparation for the trial date. The Vogelzang Law blog provides bi-weekly Asbestos Call updates.
At the Daley Center’s biweekly Asbestos Call this Tuesday, the Vogelzang Law team continued preparations for two important trials in December 2018 and February 2019. The litigation team is diligently gathering documents and conducting depositions as the end of the year approaches.
On Tuesday, Lead Counsel Nicholas Vogelzang addressed scheduling for the case of Mr. Wilbur DeBolt, who was diagnosed with mesothelioma in May 2017. Mr. DeBolt is a United States Air Force veteran who worked as a laborer and maintenance man following his service. In Mr. DeBolt’s case, he was exposed to asbestos through pumps, valves, boilers, insulation and numerous other asbestos-containing materials in various facilities.
His trial, initially set for earlier this month, was continued to February 2019. On Tuesday, Vogelzang addressed the Agreed Order for Briefing Schedule entered an order to continue the hearing date for all Motions for Summary Judgement to the next Asbestos Call on October 30.
The Vogelzang Law team also entered and continued motions in the case of Mr. Ulrich Huemmerich, who pursued a long career as a engineer in the United States after moving from Germany. He was diagnosed with biphasic mesothelioma in 2017 and passed away earlier this year. Vogelzang Law continues to represent many veterans, laborers, and engineers who often worked with a multitude of asbestos products throughout their careers.
At Tuesday’s call, the Vogelzang Law team entered and continued Motions to Compel for two defendants. One of the defendants manufactured continuous caster machines and other asbestos-containing products while the other defendant manufactured asbestos-containing panels and other insulation products. The motions were continued to the next Asbestos Call, which will take place on October 30.
The Vogelzang Law team continues to advocate for families across America who have been impacted by asbestos. Mesothelioma is a rare and aggressive cancer linked to asbestos fibers, which are easily inhaled when working with asbestos materials. As a result, insulators, pipefitters, construction workers, mechanics, and more are among the most at-risk groups.
