From Lead Counsel: November 2021

Hello again everyone! I hope you had a happy Halloween and are looking forward to a great Thanksgiving. It has been a busy and fruitful November. We continue to see the judge regularly as we work hard on all of our many asbestos cases. We worked through five mesothelioma cases set for trial three weeks ago. Although trials are rare in our area of the law, we must be prepared to try all the cases we file. While certain portions of these cases may settle early, the majority of cases will settle the week before and after the case is set for trial. The judge usually gives us several days to work out a settlement while she applies appropriate pressure to both sides to wrap up the cases if possible. Having five cases set for the same date can certainly create a fair amount of work and pressure, but it also allows for economies of scale, in that almost all of our staff is working toward the same goal of getting the cases prepared and settled at the same time. Using Zoom to communicate with the judge and defense counsel also makes it much easier to move things along. Before using Zoom, we would spend hours in the courthouse waiting for phone calls from our clients to come through. Now, we can get other work done in the office while we wait for those same phone calls and opportunities to settle our cases.

Our golf and charity season has come to a close, as I mentioned in the last newsletter. It was a whirlwind of a season, and I was happy to have it back after a year off. We are already beginning to plan our 2023 charity season, and our team is looking forward to seeing where the year will take us.

Our in-house end-of-year celebrations will look a little different this year. Sadly, we had to skip all of it last year. This year, our team is coming together for a potluck dinner later this month and an office holiday party complete with a three-piece band in December! It will be a great opportunity to begin bringing more people into the office to get reacquainted and to reminisce over how far we have come this past year.

I hope everyone remains well and safe as we look forward to the holiday season. As always, please feel free to reach out to us anytime with questions or comments. Thanks for reading, and I hope to see you all soon!
