July came to an exciting close for Vogelzang Law, as the firm achieved settlements in two major cases within a week. In a compelling take-home asbestos case, attorney Wyatt Berkover represented a Scottish immigrant and longtime Chicagoan diagnosed with mesothelioma in 2017. The firm also saw victory for a plumber and pipefitter who passed away from mesothelioma in March of this year.
Mr. Berkover’s client experienced exposure in her home, rather than in the workplace; her husband and son worked as plumbers, contributing to secondhand exposure when she handled the family’s laundry. Such cases present a unique legal challenge; the question of whether manufacturers and employers have a duty to warn family members of asbestos risks complicates liability.
Berkover argued that asbestos scarring on the client’s lungs proved that her disease was a direct result of asbestos exposure and held several defendants responsible. By Friday, July 20, only two defendants remained, an asbestos-cement pipe manufacturer and a gasket and packing manufacturer. This prompted an all-day jury selection process, and by the end of the day a diverse jury had been selected, including nurses, machine operators, parents, and accountants.
On Monday morning, the atmosphere was tense as jurors entered the courtroom. Just ahead of opening statements, the Vogelzang Law team secured settlement with the remaining defendants and the case did not proceed to trial. This settlement represents a major victory for the client, as well as all victims of take-home asbestos exposure seeking legal representation.

In another major victory that week, attorney Michael Maienza of Vogelzang Law achieved settlement on behalf of a lifelong plumber who worked in schools, factories, and powerhouses across the state and is survived by his wife.
